Article 1

Objet et champ d'application

Les présentes CGV régissent l'ensemble des relations commerciales entre Embercards, boutique en ligne domiciliée en Suisse, et tout Client souhaitant effectuer un achat via embercards.ch.

Toute commande implique l'acceptation pleine et entière des présentes CGV.

Article 2

Produits

Embercards propose des cartes à collectionner importées directement du Japon et d'Asie :

  • Boosters et displays Pokémon japonais
  • Cartes One Piece, Dragon Ball, Solo Leveling et autres TCG
  • Accessoires de collection

Tous les produits sont 100% authentiques, neufs et scellés d'usine, sauf mention contraire.

Article 3

Prix

Les prix sont indiqués en francs suisses (CHF), toutes taxes comprises. Les prix peuvent être modifiés à tout moment. Le prix applicable est celui affiché lors de la validation de la commande.

Article 4

Commande

Les commandes sont passées via embercards.ch ou par email à hello@embercards.ch. Toute commande est ferme après confirmation du paiement. Un email de confirmation est envoyé dans les 24 heures.

Article 5

Paiement

Modes de paiement acceptés :

  • PayPal
  • Virement bancaire — coordonnées communiquées à la confirmation. La commande est traitée à réception du virement.

Le paiement est exigible intégralement et à l'avance. En cas de virement, le Client dispose de 5 jours ouvrables pour payer, passé ce délai la commande est annulée.

Article 6

Livraison

Livraison en Suisse uniquement via La Poste Suisse.

  • Expédition : 2 à 5 jours ouvrables après confirmation du paiement
  • Livraison : 1 à 3 jours ouvrables après expédition
  • Numéro de suivi communiqué par email

Article 7

Politique de retour — Vente ferme et définitive

En raison de la nature des produits vendus, toute vente est ferme et définitive. Embercards n'accepte aucun retour ni échange, sauf exceptions ci-dessous.

Pourquoi ? Dans le milieu TCG, il est impossible de garantir qu'un produit retourné n'a pas été ouvert puis rescellé. Cette politique protège l'ensemble de notre clientèle.

Exceptions acceptées (signalement sous 48h avec photo) :

  • Produit endommagé à la livraison
  • Erreur d'expédition
  • Produit non conforme à sa description

Exclus de tout retour : produits ouverts ou rescellés, endommagés après réception, achetés en précommande, changement d'avis, fluctuation du marché secondaire.

Article 8

Précommandes

  • Paiement exigé au moment de la précommande
  • Date de livraison estimée, susceptible d'évoluer
  • Remboursement intégral si Embercards ne peut pas honorer la commande

Article 9

Droit applicable et litiges

Les présentes CGV sont soumises au droit suisse. Tout litige sera soumis aux tribunaux compétents du canton de Fribourg. Contact : hello@embercards.ch

Article 1

Scope

These Terms and Conditions govern all commercial relations between Embercards, an online store based in Switzerland, and any Customer wishing to make a purchase via embercards.ch. Placing an order implies full acceptance of these Terms.

Article 2

Products

Embercards offers trading cards imported directly from Japan and Asia:

  • Japanese Pokémon boosters and displays
  • One Piece, Dragon Ball, Solo Leveling and other TCG cards
  • Collecting accessories

All products are 100% authentic, brand new and factory sealed, unless otherwise stated.

Article 3

Prices

Prices are shown in Swiss Francs (CHF), all taxes included. Prices may change at any time. The applicable price is the one shown at the time the order is confirmed.

Article 4

Orders

Orders are placed via embercards.ch or by email at hello@embercards.ch. Any order is final upon payment confirmation. A confirmation email is sent within 24 hours.

Article 5

Payment

Accepted payment methods:

  • PayPal
  • Bank transfer — details provided at confirmation. The order is processed upon receipt of payment.

Full payment is required in advance. For bank transfers, the Customer has 5 business days to pay, after which the order is automatically cancelled.

Article 6

Delivery

Delivery within Switzerland only via Swiss Post.

  • Dispatch: 2 to 5 business days after payment confirmation
  • Delivery: 1 to 3 business days after dispatch
  • Tracking number sent by email

Article 7

Return Policy — All Sales Final

Due to the nature of the products sold, all sales are final. Embercards does not accept returns or exchanges, except in the cases listed below.

Why? In the TCG world, it is impossible to guarantee that a returned product has not been opened and resealed. This policy protects all our customers.

Accepted exceptions (must be reported within 48 hours with photo proof):

  • Product damaged upon delivery
  • Wrong item shipped
  • Product not matching its description

Excluded from any return: opened or resealed products, products damaged after receipt, preorder items, change of mind, secondary market price fluctuations.

Article 8

Preorders

  • Payment required at time of preorder
  • Estimated delivery date, subject to change
  • Full refund if Embercards cannot fulfil the order

Article 9

Applicable Law and Disputes

These Terms are governed by Swiss law. Any dispute shall be submitted to the competent courts of the Canton of Fribourg. Contact: hello@embercards.ch

Geltungsbereich

Diese AGB regeln alle Geschäftsbeziehungen zwischen Embercards, einem in der Schweiz ansässigen Online-Shop, und jedem Kunden, der über embercards.ch einen Kauf tätigen möchte. Die Aufgabe einer Bestellung gilt als vollständige Annahme dieser AGB.

Produkte

Embercards bietet direkt aus Japan und Asien importierte Sammelkarten an:

  • Japanische Pokémon-Booster und Displays
  • One Piece, Dragon Ball, Solo Leveling und andere TCG-Karten
  • Sammelzubehör

Alle Produkte sind 100% authentisch, neu und werkseitig versiegelt, sofern nicht anders angegeben.

Artikel 3

Preise

Die Preise werden in Schweizer Franken (CHF) inklusive aller Steuern angegeben. Preise können jederzeit geändert werden. Massgeblich ist der zum Zeitpunkt der Bestellbestätigung angezeigte Preis.

Artikel 4

Bestellung

Bestellungen erfolgen über embercards.ch oder per E-Mail an hello@embercards.ch. Jede Bestellung ist nach Zahlungsbestätigung verbindlich. Eine Bestätigungs-E-Mail wird innerhalb von 24 Stunden versandt.

Artikel 5

Zahlung

Akzeptierte Zahlungsmethoden:

  • PayPal
  • Banküberweisung — Kontodaten werden bei Bestätigung mitgeteilt. Die Bestellung wird nach Zahlungseingang bearbeitet.

Die vollständige Zahlung ist im Voraus fällig. Bei Banküberweisung hat der Kunde 5 Werktage Zeit zur Zahlung, danach wird die Bestellung automatisch storniert.

Artikel 6

Lieferung

Lieferung nur in der Schweiz über die Schweizerische Post.

  • Versand: 2 bis 5 Werktage nach Zahlungsbestätigung
  • Lieferung: 1 bis 3 Werktage nach Versand
  • Tracking-Nummer per E-Mail

Artikel 7

Rückgaberecht — Endgültiger Verkauf

Aufgrund der Natur der verkauften Produkte sind alle Verkäufe endgültig. Embercards akzeptiert keine Rücksendungen oder Umtausch, ausser in den unten aufgeführten Fällen.

Warum? Im TCG-Bereich ist es unmöglich zu garantieren, dass ein zurückgesandtes Produkt nicht geöffnet und wieder versiegelt wurde. Diese Richtlinie schützt alle unsere Kunden.

Akzeptierte Ausnahmen (Meldung innerhalb von 48 Stunden mit Foto):

  • Bei Lieferung beschädigtes Produkt
  • Falscher Artikel geliefert
  • Produkt entspricht nicht der Beschreibung

Von jeder Rückgabe ausgeschlossen: geöffnete oder erneut versiegelte Produkte, nach Erhalt beschädigte Produkte, vorbestellte Artikel, Meinungsänderung, Schwankungen des Sekundärmarkts.

Artikel 8

Vorbestellungen

  • Zahlung zum Zeitpunkt der Vorbestellung erforderlich
  • Geschätztes Lieferdatum, kann sich ändern
  • Vollständige Rückerstattung, falls Embercards die Bestellung nicht erfüllen kann

Artikel 9

Anwendbares Recht und Streitigkeiten

Diese AGB unterliegen dem Schweizer Recht. Streitigkeiten werden den zuständigen Gerichten des Kantons Freiburg vorgelegt. Kontakt: hello@embercards.ch
